The Consumer Protection Act in South Africa
The Consumer Protection Act 68 of 2008 (CPA) is one of South Africa’s most important pieces of consumer legislation. It protects consumers in their dealings with suppliers of goods and services, promoting fair, honest and transparent business practices.
Key consumer rights
- The right to fair, honest dealing and to be free from unfair marketing.
- The right to fair and reasonable terms and conditions.
- The right to safe, good-quality goods.
- The right to disclosure of information in plain and understandable language.
- The right to choose, and to cancel certain agreements.
The cooling-off period
For goods or services bought as a result of direct marketing, the CPA gives consumers a cooling-off period of five business days, during which they can cancel the agreement without penalty and without giving a reason. This is a valuable protection against high-pressure sales.
Defective goods and the implied warranty
Section 56 of the CPA creates an implied warranty of quality. If goods are defective, unsafe, or fail within six months of delivery, the consumer may return them and choose a repair, replacement or refund — the choice belongs to the consumer, not the supplier. This applies even without a separate guarantee.
Unfair terms
The CPA prohibits contract terms that are unfair, unreasonable or unjust, and requires that important terms — especially those that limit rights or place risk on the consumer — be brought to the consumer’s attention. Terms that seek to waive the consumer’s core rights are generally unenforceable.
How to complain
If a supplier will not resolve a problem, you can complain to the supplier’s industry ombud, a provincial consumer authority, or the National Consumer Commission. Disputes can be referred to the National Consumer Tribunal. For smaller money claims, the Small Claims Court may also be an option.
